When Do You Need a Party Wall Surveyor?

The Party Wall etc. Act 1996 is one of the most misunderstood pieces of property legislation in the UK. Many homeowners only discover their obligations after starting works โ€” by which point their neighbour can obtain a court injunction to halt the project. Here is a straightforward guide to when you need a party wall surveyor and what the process involves.

What Is a Party Wall?

A party wall is a wall that stands on the boundary between two properties and is shared by both. It includes walls that form part of one building but are built astride the boundary, floors between flats in a converted house, and garden boundary walls.

What Works Trigger the Party Wall Act?

You must serve party wall notices before carrying out any of the following:

  • Section 2 โ€” Works to existing party walls: cutting into a party wall (e.g. for a steel beam), raising or underpinning a party wall, demolishing and rebuilding a party wall, weatherproofing a party wall, cutting flashings into a neighbour’s wall
  • Section 1 โ€” New wall on or at the boundary: building a new wall that will sit on or straddle the boundary line
  • Section 6 โ€” Excavations near a neighbouring property: digging within 3 metres of a neighbouring structure where you will go deeper than the neighbour’s foundations; or within 6 metres where excavation will cut a 45-degree line drawn from the bottom of the neighbour’s foundation

Common Projects That Trigger the Act

The most common domestic projects that require party wall notices include: rear extensions (Section 2 and possibly Section 6), loft conversions involving a party wall (Section 2), basement conversions with underpinning (Section 6), chimney breast removals on shared walls (Section 2), and new garden walls on the boundary (Section 1).

What Happens After You Serve Notice?

Your neighbour has 14 days to respond. They can: consent in writing (allowing works to proceed under the protection of the Act); dissent and agree on a single agreed surveyor acting for both parties; or dissent and appoint their own surveyor. If they do not respond, they are deemed to have dissented after 14 days.

Where a dispute exists, the appointed surveyor(s) prepare a Party Wall Award โ€” a legally binding document setting out how works will be carried out, when, and what protection your neighbour’s property will receive. It also typically includes a Schedule of Condition recording the state of your neighbour’s property before works begin.

How Much Does a Party Wall Surveyor Cost?

An agreed surveyor (acting for both parties) typically charges ยฃ800โ€“ยฃ1,400 for straightforward works. Separate surveyors each charge ยฃ700โ€“ยฃ1,200, with the building owner normally paying both fees. More complex projects โ€” basements, multiple neighbours โ€” can cost ยฃ2,000โ€“ยฃ6,000+.
